Dealing in Stolen Property

Dealing in Stolen Property | Melbourne Criminal Defense Lawyer

If you have been arrested for dealing in stolen property in Brevard County, FL or anywhere along Florida’s Space Coast, you need aggressive legal representation as soon as possible. Dealing in Stolen property is a serious felony offense and it has to be defended aggressively by an experienced criminal defense lawyer. A criminal conviction for dealing in stolen property in Florida carries life-altering consequences. Below are the Florida Statutes pertaining to Dealing in Stolen Property:

Dealing in Stolen Property Under Florida Law

Any person who traffics in, or endeavors to traffic in, property that he or she knows or should know was stolen shall be guilty of a felony of the second degree. A Second degree felony conviction is punishable by up to 15 years in prison, up to 15 years probation, and/or a $10,000 fine. A person who initiates, organizes, plans, finances, directs, manages, or supervises the theft of property and traffics in such stolen property shall be guilty of a felony of the first degree. A first degree felony conviction is punishable by up to thirty year prison, up to thirty years probation, and/or a $10,000 fine.

Many times, dealing in stolen property charges are coupled with arrests for burglary, theft, and/or giving false information to a pawnbroker/secondhand dealer. Frequently, the "trafficking" or dealing in the property is performed at a pawn shop, however, dealing in stolen property may take place by use of the internet, be it eBay, craigslist, etc. Florida’s Legislature has amended the dealing in stolen property statute many times recently to combat these crimes. Despite the new laws, the proof of "knowledge" in a case like this can be problematic. It can be difficult for prosecutors to prove that a person was aware that the property he or she sold was stolen. Our attorneys will examine the issues in involved in your individual case for any possible defenses.
