Child Pornography under Florida Law

Child pornography is any depiction of a minor under age 18 engaging in sexual behavior or in sexually suggestive poses. To be child pornography, the image must be of a minor and sexually explicit in nature, or the focus of the image must be lewd or lascivious. A “depiction” may include photographs, videos and other representations. Possessing any child pornography is a serious felony offense under both Florida statutes and federal law. Under Florida law, possession of child pornography is a third-degree felony punishable by up to five years in prison. Each photograph/video constitutes a separate charge, and duplicate photos can be charged individually. For example, possession of five photos could result in up to 25 years in prison. In addition, Florida law allows for enhanced sentencing if the material in question depicts certain sexual acts or a child under the age of five.

Defending Against Child Pornography Charges in Florida

As with all crimes, the State must prove child pornography charges beyond and to the exclusion of every reasonable doubt. A prosecutor must prove that the defendant was in actual possession of the pornographic material – which can be difficult if the computer in which the pornography was found was shared between several people. Depending on the circumstances, it is not always possible to pinpoint the exact user responsible for introducing and possessing the material. In addition, it is sometimes difficult to determine whether the individual depicted on photo/video is or was a “minor” at the time the image was captured. These are just several issues that an experienced Melbourne Sex Crimes attorney can explore on your behalf. Contact us today.
